Gent.mo Avv. Solignani,
sono sposata con un ragazzo divorziato e con una figlia per la quale aveva concordato una cifra mensile di mantenimento che dopo 12 anni è diventata di circa euro 700 al mese più le spese extra.
Al momento del divorzio aveva un reddito più alto e quindi poteva permettersi la cifra concordata. Noi poi abbiamo avuto una figlia e con la crisi le entrate sono diminuite di molto, la cifra che mio marito ora mette a disposizione per la casa in generale per sostenere tutte le spese comprese quelle relativa alla nostra figlia è di 900 euro al mese e io contribuisco in proporzine al mio stipendio.
Viste le difficoltà per arrivare a fine mese è giusto che in casa nostra si debba guardare all’euro mentre nell’altra famiglia ricomposta no? Specifico che anche l’ex moglie lavora e convive con un nuovo compagno da subito dopo la separazione che però ovviamente non ha mai preso la residenza nella casa che è della madre di mio marito senza pagare affitto.
Ci sono norme che tutelano anche il nostro tenore di vita e in modo particolare quello di mia figlia per la quale devo provvedere in buona parte io a tutte le spese?

I nuovi figli per i giudici di solito non sono un presupposto per la diminuzione del mantenimento «promesso» a quelli già esistenti: si fa capo al concetto per cui la procreazione oggigiorno è, almeno potenzialmente, un fatto responsabile, per cui ognuno deve farci i conti prima di provvedervi. Non dico sia giusto, ma è il concetto di riferimento.
